By accessing or using Backly.io ("the Service"), operated by Backly.io ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Backly.io is a software-as-a-service platform that uses artificial intelligence to analyze websites, identify backlink opportunities, and generate content suggestions for link-building purposes. The Service is provided on a subscription basis with various plan tiers offering different usage limits.
3. Account Registration
To use the Service, you must create an account using Google OAuth. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information during registration. You must be at least 18 years old to use the Service.
4. Subscriptions and Billing
The Service offers paid subscription plans billed on a monthly recurring basis. Prices are displayed in Euros (EUR) and are subject to change with 30 days' prior notice. Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through the billing portal. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Use generated content for spam, harassment, or any form of abusive behavior
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Share your account credentials or allow unauthorized access to your account
- Use automated tools to access the Service beyond the provided API and interface
- Resell, redistribute, or sublicense access to the Service without written consent
6. AI-Generated Content
Content generated by the Service is produced using artificial intelligence and is provided as-is. You are solely responsible for reviewing, editing, and using any generated content. We do not guarantee the accuracy, quality, originality, or suitability of generated content for any specific purpose. You retain full responsibility for any content you publish based on our suggestions.
7. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by Backly.io and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Content generated through the Service may be used freely by you, but the Service itself remains our property.
8. Limitation of Liability
To the maximum extent permitted by law, Backly.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We make no guarantees regarding SEO results, search engine rankings, or the effectiveness of any backlink opportunities identified by the Service.
10. Termination
We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in conduct that we determine to be harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after account termination.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which Backly.io operates. Any disputes shall be resolved through good-faith negotiation, and if unsuccessful, through the competent courts of that jurisdiction.
